Terms and Conditions

The following terms and conditions apply to all our online sales. Please read them carefully, when purchasing goods online you are entering into a legally binding contract and the information contained in this page forms part of that contract.

There are no surprises or "small print" here, just standard conditions that we adhere to with all our sales.  Some of the following are required by UK trading law, some are our own conditions of sale such as our returns policy.

Privacy Policy

At Emporium Antiques we are committed to protecting your privacy. We use the information we collect about our customers to process orders and to provide a more personalised shopping experience. We may also use it to tell you about changes in our services or about goods or special offers we think you might be interested in. We do not sell, trade or rent your personal information to others.

Under the UK Data Protection Act 1984, we follow strict security procedures in the storage and disclosure of any information which you have given us, to prevent unauthorised access. Our security procedures mean that we may request proof of identity before we are able to disclose sensitive information about you.

What information do we hold and how do we obtain it?

  • Directly from you, usually when you purchase goods from us or receive our services. (e.g. your name, address, telephone number and credit card details).
  • Indirectly from you, through your use of our services. (e.g. your email or telephone calls).

For what purposes do we use your information?

We use your information for a number of purposes which can be broadly categorised under two headings:

  • To ensure that the goods you have purchased are delivered to you as efficiently as possible.
  • For other non-contractual reasons.  Set out below are some examples of the purposes falling within each category.

Provision of Service.

We, or reputable parties acting on our behalf, may use your information:

  • To identify and maintain records of your account and in order to provide you with usage and billing information.
  • To ensure that the services we offer you continue to be the most appropriate service for your needs.
  • To respond to any query that you may raise with us about your account.
  • To update our systems for enhanced service provision to you.

Other Purposes.

We will also use information about you for purposes upon which the provision of services is not necessarily dependent.  To this end, we may:

  • Disclose information to any third party to whom you reasonably request that we pass such information or to whom you authorise us to pass information (note: we may also pass information about you and your account to a third party whom we reasonably believe to be acting with your consent such as members of your family or your household.  If you have specific concerns about such disclosure you should notify us and we will put in place extra security measures for your account).

We undertake to you that we will:

  • Endeavour to keep any information about you up-todate and accurate.
  • Endeavour to protect your data against unauthorised or unlawful use.

YOUR RIGHTS

You have certain rights under the new legislation in relation to the information that we hold about you.  The most important of these rights is set out below:

Access to information about you.

You may request in writing details of the personal information that we hold on you and the purpose for which it is held.  We will usually provide such details to you by way of a photocopy or computer print out in the form that such details are held on our system.  However, provision of such information may be subject to an administration charge (as permitted by the legislation).  If you wish to receive details of the information that we hold about you, you should write to the address given at the bottom of these terms and conditions and enclose a cheque for £10 payable to Emporium Antiques.  Your request will be met within 40 days.  If you have a concern about a specific use that we are making of your information, it may help us to identify the data in question if you set out details of your concerns in writing.

Information about our Services.

You may request at any time in writing that we stop using information about you for the purposes of informing you about our services.  You may also request that we delete any directory entry concerning you or your business.

eBay Auctions

By participating in auctions hosted by eBay International AG you are agreeing to their terms and condition as described here, caveat emptor.

Extract: Bidding and Buying.
If you are the highest bidder at the end of an auction (meeting the applicable minimum bid or the reserve requirements) and your bid is accepted by the seller, you are obligated to complete the transaction with the seller, unless the item is listed in a category under the Non-Binding Bid Policy or transaction is prohibited by law or by this agreement. By bidding on an item you agree to be bound by the conditions of sale included in the items description (or linked to from the description) so long as those conditions of sale are not in violation of this Agreement or unlawful. Bids are not retractable except in exceptional circumstances such as when the seller materially changes the item's description after you bid, a clear typographical error is made, or you cannot authenticate the seller's identity.

Our specific conditions relating to the sale of goods on eBay are as follows:

  • Initial Contact Period
    We will contact you within 72 hours of an auction closing. We consider it the responsibility of both buyer and seller to contact the other party.
  • Contract Default
    If, after at least seven days after the end of an auction, the high bidder hasn't responded or we feel that the high bidder isn't going to complete the transaction we will file a Non-Paying Bidder Alert with eBay. Details of eBay's default process can be found here.
  • Payment
    Payments for auctions must be received within 10 days of the close of the auction.  All our sales are in Pounds Sterling.  Further details of our available payment options can be found here.
  • Shipping & Postage
    Details of available shipping options can be found here. We reserve the right to delay shipment of goods until fully cleared funds are available. With online payments this is considered to be as soon as authorisation confirmation is received from our bankers. With cheque payments we are regulated by the clearing banks normal clearance time.

Returns Policy

It is our intention to provide a full and accurate description of the goods we sell including details of any damage or restoration. We will also on occasions use our professional experience to date items where that information is not immediately apparent. We extensively photograph the items we offer for sale on eBay and these photographs together with our written description of the item is considered as part of our contract.

Should an item be professionally proved to be not as we describe then you should contact us immediately by email stating the eBay sale reference. DO NOT RETURN GOODS to us until we give you instructions to do so. Returns are accepted at the discretion of Emporium Antiques and refunds will be given in the same tender type as the original payment. The following applies:

  • Goods should be returned in the original packaging.
  • Goods must be returned by the most economical method. They remain your property until we have received them.
  • Goods must be returned in the same condition as when offered for sale.
  • You should allow up to 14 days (in addition to delivery time) for returns to be processed.

Returns are only accepted on grounds of condition or error in description, we will not accept returns because of a change in your circumstances or simply a change of mind.
